EQ Storytelling Terms and conditions

By using the service of EQ Storytelling you agree to these terms and conditions.

Agreement:

· EQ Storytelling will supply a written project summary before any work commences, including the estimated timeframe and final fee.

· Before work on the project commences the client will provide EQ Storytelling with written confirmation that the client has read the terms and conditions, is authorised to commission the project, and agrees to the responsibilities, timeframe and fees stated in these terms and conditions.

· The client will provide written approval of final copy prior to publication.

Accuracy:

· The client has final legal and ethical responsibility for all published material written by EQ Storytelling for the client.

· It is the client’s responsibility to ensure that to the best of the client’s knowledge, all information provided to EQ storytelling is legal and accurate.

·While EQ Storytelling will work hard to ensure all copy is proofread, grammatically accurate and factually sound, the content of the final published project is the responsibility of the client. 

Payment:

· A non-refundable deposit of 50% of the fee is required to be paid upfront by the client.

· Final projects will be returned to the client for proofing and up to two edits. Any additional request will incur an additional fee of $85 an hour (GST inclusive).

· Payment of the final invoice from EQ Storytelling is due within seven days.

· Overdue payments will incur an additional 10% fee for each week they are late.

· Payment plans and special requests can be arranged by prior agreement.

Permission:

· EQ Storytelling has permission to use any of their work or recordings as a reference for their portfolio, unless stated otherwise by the client.

· Once the project is completed and final payment has been received, all copyrights are automatically transferred to the client.

· The client may not use any material developed and written by EQ Storytelling in any medium until copyright is transferred to the client.

Privacy:

· Any information provided by the client that is not included in the final proof shall be deemed to be confidential, unless stated otherwise by the client.

Termination of project:

· The project is deemed to be completed upon payment of the final fee, subject to early termination as set out below.

· The project may be terminated early by the client with written notice to EQ Storytelling.

· The project may be terminated early EQ Storytelling with written notice to the client if the client:

o   fails to respond to communication from EQ Storytelling within 14 days

o   breaks the terms and conditions agreed

o   provides offensive, unlawful or dishonest content or otherwise acts unethically

· If the project is terminated early under these terms and conditions, by the client or by EQ Storytelling, the deposit and any other payments received shall be forfeited by the client.

· The project remains the intellectual copyright of EQ Storytelling if a project is terminated early. Use of the content provided by EQ Storytelling to the client in any medium after early termination is not permitted.
